Privacy Policy

The short version

A privacy policy describes important details regarding the use your personal information (below referred to as 'data'). Please know, I completely respect your privacy and will take all measures to protect your data just as I do for myself and my family.

Regardless of how your identity and contact information is collected (online purchase, services inquiry, newsletter, giveaway etc.), rest assured that your data is kept private and I will never sell or redistribute your data unless required by law. In the event of legally required access or unauthorized access by a third party, you will be notified as soon as possible. Any data in my possession will only be used as required to provide services and digital/tangible products.

While I make every effort to ensure the safety, privacy and security of my website and a client's data, you share such information at your own risk. Never send data such as credit card or account information via social media message or email. Only pay for purchases via the secure checkout on my website and online quotes/invoices. If you have a concern, contact me to arrange to purchase or sign in-person before entering data. 

I also utilize postal and email mailing lists to share news and marketing. If you wish to be removed, contact me. For mail, provide your mailing address and for email click the unsubscribe link in your email or email amber@soulgazephotography.com. 


Privacy Statement

1. WHAT DO I DO WITH YOUR INFORMATION?

When you purchase from my online store, as part of the buying and selling process, personal information (data) such as your name, address and email address is collected.

When you browse my website, photosite or store, your computer’s internet protocol (IP) address is automatically collected in order to provide statistics about visitor browsers and operating systems. Your IP address may also be used to investigate fraudulent charges, attempts to hack or otherwise harm my business or my clients.

I occasionally utilize postal and email mailing lists to share news and marketing. You may opt-out at anytime by contacting me.  

2. CONSENT

How do you get my consent?
When you provide data to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, you consent the collection of said data to be utilized for that specific reason only. For reasons such as marketing, I will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for me to contact you, store your data, at anytime. However, not all data can be purged such as data required for contracts, releases, invoices and bookkeeping. 

3. DISCLOSURE

I will only disclose your data if required by law to do so or if you violate the Terms of Service.

4. THIRD-PARTY SERVICES

My website, blog and store are hosted on Squarespace.com. My photosite, for archiving and sharing images is hosted on Smugmug.com. They provide the platform that allows the selling of products and services to you. Any data stored through their data storage, databases and the general application is stored via a secure server behind a firewall. However, I am not responsible for any breach of data by a third party vendor. If my vendors ever notify me of a breach, all potentially affected clients will be notified.

The third-party vendors I use will only collect, use and disclose your data to the extent necessary to allow them to perform the services they provide to me. However, all vendors, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information I am required to provide for your purchase-related transactions. I recommend you read their privacy policies so you can understand the manner in which your data will be handled by these vendors:

In particular, remember that certain vendors may be located in or have facilities that are located a different jurisdiction than either you the client or me the owner. If you proceed with a transaction that involves the services of a third-party vendor, then your data may become subject to the laws of the jurisdiction(s) in which that vendor or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your data used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave my website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or by this website’s Terms of Service.

6. SECURITY

To protect your data, I take reasonable precautions and follow industry best practices to ensure data is not lost, misused, accessed, disclosed, altered or destroyed. If you provide me with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, I follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Your credit card data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by my store and its service providers. 

7. COOKIES

8. AGE OF CONSENT

By accessing this website, my photosite and any other domains, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given your consent to allow any of your minor dependents to use this site.

9. CHANGES TO THIS PRIVACY POLICY

I reserve the right to modify this privacy policy at any time. It is best reviewed frequently. Changes and clarifications will take effect immediately upon posting via the date of last update as listed at the bottom of the page. If I make major changes to this policy, I will attempt to notify you, so that you are aware of changes regarding what data is collected, how data is used and under what circumstances, if any, I use and/or disclose data. If my company is sold or merged with another company, your data may be transferred to the new owners in order to continue to sell products to you. You will be notified of such a change and will be provided the opportunity to opt-out.
